Terms & Conditions

The terms and conditions of business under which driving instruction is provided are outlined below. They are a contract between the student [including the person or business responsible for funding the instruction] and CROFTdriving.

Any amendments to these terms and conditions will be advised 7 days prior to the amendment.

By accepting instruction from CROFTdriving the student accepts these terms and conditions.

  1. Code of Practice.
    1. CROFTdriving abides by the professional code of conduct which can be found here: Approved driving instructor (ADI) code of practice – GOV.UK (www.gov.uk)
    2. CROFTdriving agrees to provide a car which is legally roadworthy, taxed, insured and with a valid MOT certificate if required.
    3. The car will be clean, tidy and fitted with dual controls.
  1. Entitlement to drive.
    1. The student must hold a current, valid driving licence that entitles them to drive in the UK.
    2. The student must be medically fit to drive including the regulations for eyesight, being able to read a numberplate at a distance of 20.5 metres [67 feet] with glasses/contact lenses if normally worn.
    3. The driving licence must be produced at the first lesson and on demand subsequently. Any restrictions of any sort [points, convictions, endorsements, bans] must be advised to the instructor immediately.
  1. Fitness to drive.
    1. It is the student’s responsibility to ensure they are fit to drive and inform the instructor of any medical condition, disability or injury that affects their ability or entitlement to drive and inform the instructor immediately if they feel unwell before or during a lesson.
    2. The student MUST not drive whilst under the influence of alcohol or drugs including the day after consuming/taking alcohol/drugs when they may still be over the prescribed limit.
    3. The student must wear suitable footwear and clothing that does not restrict movement.
    4. The instructor will not tolerate any form of physical or verbal abuse at either himself, an examiner or other road user and may terminate the lesson if, in their sole opinion, feel it inappropriate to continue because of any indiscretion. The lesson fee is forfeit and continued transport is at the instructor’s discretion.
  1. Lesson fees.
    1. Lesson fees are advised at the time of booking and are payable in advance through the appropriate booking portal.
    2. Special offers are provided by CROFTdriving and may be withdrawn at any time.*
    3. CROFTdriving does not provide credit facilities.
    4. These are non refundable.
  1. Change of tuition vehicle.
    1. Tuition vehicles are periodically changed, either permanently or when a vehicle is replaced temporarily due to mechanical or
      other problems.
    2. CROFTdriving is not responsible for any losses if the student chooses to decline lessons in another vehicle.
  1. Lesson cancellations.
    1. CROFTdriving may need to cancel lessons at short notice due to adverse weather, a fault with the instructor’s car, the instructor being ill or any other emergency occurrence. The student will be notified as soon as possible.
    2. The instructor will rearrange the lesson at a time suitable to both parties. Any lesson that cannot be rearranged will be refunded.
    3. The student must give 48hours notice when cancelling a lesson or the lesson will be charged in full.
    4. In the opinion of the instructor, if the student is incapable or unfit to drive for whatever reason, the lesson can be cancelled and charged in full.
  1. Lesson times.
    1. The student should keep a record of lesson times and dates to avoid any missed lessons.
    2. The instructor will wait a maximum of 10 minutes after the lesson start time before considering the lesson cancelled.
    3. The instructor will make every effort to attend lessons punctually but traffic conditions may affect this and the student should allow a 10 minute waiting period.
    4. Should the student require the instructor to pick up or drop off at a different location than originally agreed then 24 hours notice should be given.
  1. Driving tests.
    1. Tests should NOT be booked without first ascertaining the availability of the instructor and agreeing readiness to take the test.
    2. No responsibility will be taken by CROFTdriving for tests booked by the student at times when the instructor is unavailable.
    3. The instructors car will be available to the student for test purposes at the same rate as a 1 hour lesson plus a £20 return to drop off location fee.
    4. Students are responsible for notifying the instructor of the time, place and date of tests. The instructor takes no responsibility for incorrect information provided by the student.
    5. Students will only be allowed use of the instructor’s car for the test if the instructor agrees the student is at test standard. The instructor may refuse use of the car if, in his professional opinion, he considers the student has not reached sufficient competency to take the test.
    6. If the use of the car is withheld for a test then every effort will be made to give adequate notice to cancel/rearrange the test without loss of the test fee.
    7. If a test is cancelled due to a fault with the instructor’s car, the instructor’s illness or another reason that is the instructor’s responsibility then the next test fee will be met by the instructor if there is insufficient notice to cancel the test without loss of the fee.
  1. Students’ property.
    1. The student is responsible for the care of any property they bring with them when attending a lesson and should ensure they do not leave anything behind. CROFTdriving take no responsibility for any loss or damage to any property belonging to, or in the possession of, the student.
  1. Legal Liability
    1. The student, in accordance with road traffic law, is legally responsible for any traffic offences that occur while they are in charge of the vehicle.
  1. Complaints.
    1. Any complaints should be raised directly initially with the instructor or, if they remain unresolved, through the procedures set out in the code of practice.
  1. Data Protection
    1. Any data held by CROFTdriving is held securely and is used ONLY for use by CROFTdriving and will not be passed to any third party unless required to do so by law.

13. Special Offer Conditions

1.The offer may be withdrawn at any time.

2. A block of lessons is ten lessons of 60 or 90 minute duration.

3. Subject to lessons being available.

4. Subject to the instructor agreeing pupils are test ready.

5. Price guarantee valid for 18 months from date of first payment.

6. Lessons must be booked and paid for before 30/9/22.

7. Offer ends midnight 30th September 2022.
